Naturally. I can hope for it, but I would never expect them to counter-sue. They’re the person harmed, so they get to decide what justice looks like for them, and sometimes people just want to go back to normal.
Sanctions are really the only thing the judge has at their disposal, and I doubt Nintendo’s lawyers are dumb enough to get sanctioned.

This is not about the legality of emulation, unfortunately, but about whether people have the rights to publish lets plays without a license.
Many suits in the gaming industry see lets plays as theft. They see people making money using their games and believe lets players should have to pay to license thst content, and that they should have the right to revoke that license if they don’t like what people are saying about or doimg with their games.
I work in the industry, and I know people who work or who have worked at studios owned by every major punlisher in the west. This is a thing they all habe someone of import chomping at the bit for.
It’s just that none of them want to be the one singled out as the first or only one attacking lets plays. Nor to be the one that shoulders the costs of having their position challenged in court.
From the article it sounded like they were doing reviews, not let’s plays. Reviews are inherently and substantially more transformative. They’re not merely appending the content as it is played. They’re supporting their assessments and reasoning with footage and proof.
Just to be clear, publishers don’t like reviewers, either. They’re seen as gatekeepers of audiences and people to be managed and bribed, and that means keeping the reviewer market small. They want reviewers to be PR people with a fascade of being impartial, and few enough to count on one hand.
This is also somwthing that’s happening, then, because Nintendo sees a pathway to victory. Not only are their games licensed only for their own hardware, but they can claim the reviews are misleading and invalid because the games aren’t designed to run on the platforms they’re beinf reviewed on.
Like, none of this is Nintendo coming for your emulation catalogue. It’s them coming for people trying to generate an income from their games. And all of the big publishers are going to line up behind them on this, because they also hate anyone who’s making coin using their creation.
That’s capitalism. That’s what it means for something to be capital, and to own it. It’s what owning the means of production is all about.

They’re so amazingly dogmatic, too. There’s this subtext belief that Nintendo’s business decisions are somehow profoundly and uniquely wise, such as the claim that there can’t be a new F-Zero game because “there’s no conceivable way to make it different each time, which is a Nintendo™® mandate” as if it wouldn’t be enough to add weapons to the vehicles, customization/performance modifications, power allocation, outright flying or even space segments, or even out-of-the-car gameplay.
Nope. Just the “make it different each time” of the Zelda plot rehashes forever and ever.
Or, make it “different each time” by making it janky in a way most people don’t like, like Star Fox Zero which was also a plot rehash, and then shelve the franchise because people didn’t like it. Nintendo is that infallible!
I think there’s a pervasive myth about Nintendo, and that is that their games don’t innovate on themselves. Sure, there are maybe some titles that are not so innovative and seem like rehashes, but then there are the games that do that receive universal acclaim. Even using Zelda as an example. Majora’s Mask is an asset flip of Ocarina of Time, yet it does so many things differently and both are unique must play experiences. Coming from LttP to the N64 was a revelation. Metroid Prime is an inspired evolution of the classic Metroid game design. Paper Mario came out of nowhere and blew everyone away for a couple generations. Breath of the Wild had some of the most exciting emergent gameplay out of any title ever released. Even on a bad day, Nintendo innovates harder than Ubisoft has ever done. Don’t let the fanboys tell you what Nintendo is thinking. They’re full of shit. Nintendo isn’t making a new F-Zero game purely because there isn’t any demand for it. Nintendo is not allergic to money.
That being said, fuck their over litigious anti-consumer tactics. It loses them goodwill with the gaming community.

Oh. Joy. I am certain the Mario odyssey modders who have been showcasing hide and seek along with prop hunt as ways to play the game with friends after enjoying the official experience will appreciate their hard work being flagged and demonitized.

Damn… Seeing the Ayaneo Flip DS in the picture, I just wanna say that I love that thing. (But its very expensive). It’s perfect for DS, 3DS, WiiU and most Switch games.
