I am defending the man.
Kilmar was only considered a “gang member” because in 2019, some
copbastard shook down a bunch of day laborers at a Home Depot, then wrote in his report that Kilmar was MS-13, because he was wearing the “wrong clothes.” Kilmar went to jail.Two days later, that cop was suspended (and ultimately admitted to) falsifying records, including Kilmar’s.
Kilmar spent several months in jail anyway, only being released by the court when it was ruled that he could stay in the country under asylum, because his life would be in danger if he went back to El Salvador. That’s why he is a legal resident of the US.
The sole piece of “evidence” being held up to say that Kilmar is in any way dangerous is the admittedly false police report.
And that’s an excellent defense that should be brought up in court.
Getting bogged down in the debate of guilt muddies the water from the key due process question.
If you start arguing guilt in the public opinion space you end up with guilty or not guilty being the options.
If you argue due process you have “support the constitution” and “shit on the constitution”. It’s why the shitting on the constitution side wants to argue about guilt, not due process or if sending people to foreign prisons is legal or ethical.So while he’s certainly innocent, it doesn’t matter and isn’t worth discussing until he’s in court.
Sure, but the point is that even if all of that information were credible, hell, even if he beheaded someone live on the 8 o’clock news, he has a right to a fair trial and ponderance of the evidence as do we all.
Yea, whether or not he’s guilty is besides the point.
Maybe the evidence against him was fabricated, maybe he got got through some parallel construction shit.
Maybe he’s a gang member, but it can’t be proved, maybe he’s not, it’s all moot.
That’s all irrelevant because he’d still have rights to due process.
This is important because that is the reason for due process. So that someone can’t be railroaded with a bunch of false shit. The process is what gets to the truth of the matter.

I think the guy had a restraining order or something. It’s good that he doesn’t want any kind of distraction to the fact that he shouldn’t have been sent there in the first place, and now he needs due process. Also, the republicans are defying direct orders from judges.
The problem is none of them should be there. They all have had their due process rights violated. Due process is afforded to everyone. Not just citizens etc. And it is extremely wilting and milquetoast to preemptively toss the man aside while claiming to defend his rights. We shouldn’t have to be speculating on whether or not this exists. Or is an actual thing. If someone brings it up in bad faith then address it there. But till then he should be defending all of them.
Because let’s be honest. Why not defend the man? If having a restraining order for any reason is enough to get someone deported. Then let’s go whole hog and Deport every Republican that has ever Jay walked in their lives. It’s practically as serious a crime. And we will all be safer for it.
in order to be a all useful a restraining order needs to be obtainable under minimal proof standards. As such they are meaningless excpet to the exact specifics of the order and must not be used for anything else.
Some retstraining orders save lives. However others are used to abuse someone (usually an ex).
It was to smear the guy’s reputation so they could continue doing things that are unethical and illegal.
